>> in the family is shocked that someone wearing a name tag at the hospital might have seen her suffering in the stairwell and even told another staff member. >> he said words in the effect that there was a person lying on the stairs between the third in the fourth floor. >> he stated that he's not sure that if they ever did a complete search to locate her. >> i cannot believe that they searched the stairwell to find is woman. >> the lawyer stated that he expects a year from the sheriff's office this week about win, where, where the deputies actually searched. maybe also explain why she was wearing street clothes when they found her. >> new information on the sonoma county deputy who shot and killed 13-year old andy lopez last week in santa rosa. the deputy has been been

identified as 48-year-old erick gelhaus. a 24-year veteran of the sheriff's office. he is also a field training officer and firearms instructor. he and another deputy were on patrol when they spotted lopez with what turned out to be a replica a-k-47. several agencies are investigating - including the f.b.i. but it's gelhaus' own words that are putting his actions >> in an article he wrote in swat magazine back in november 2008, he said -- "today is the day you may need to kill someone in order to go home. somebody needs to be in charge, so make a decision." >> and in the same article, he said "when you are caught in an ambush, you need to make your decisions immediately and carry them out just as quickly. you need to shut down the bad guys who initiated the ambush so that you can go home." >> hundreds of people are expected to march through downtown santa

rosa tuesday afternoon to protest the fatal shooting of a 13-year-old andy lopez by sonoma county sheriff's deputy erick gelhaus last week. santa rosa police are advising motorists to expect traffic congestion on mendocino avenue between downtown santa rosa and the bicentennial way just north of the sheriff's office between noon and 5 p.m. a post on the justice for andy lopez facebook page states one group of marchers will gather at noon at old courthouse square and another group at santa junior college further north. the groups will join around 2 p.m. and march to the sheriff's office at 2796 ventura ave. for a protest around 3 p.m. >> patient care and service workers at the ten university of california campuses across the state began voting today

on whether to authorize a strike based on their union's allegation that the university engaged in unfair labor practices. todd stenhouse, a spokesman for american federation of state, county and municipal employees local 3299, which represents 22,000 employees, said the voting will continue through the end of the day on wednesday and the results probably won't be announced until early next week. stenhouse said if workers vote to authorize a strike, they could go on strike at some point in the near future after giving notice but the union still hopes to engage in further bargaining with the university. he said the union has filed a complaint with the state public employment relations board alleging that uc engaged in unfair labor practices by threatening the jobs of employees who staged a two- day strike at five uc medical centers in may. >> we are waking up to cold temperatures. as for the afternoon we will see more sunshine that what we saw

host had a $200,000 lamborghini stolen. he was only 17 at the time is accused of stealing the car and prosecutors say was a mission in possible theft. he stated that he still remembers getting word about his stolen car. >> i was in chicago and because of the cameras were rolling at the time when i answered the phone i thought someone was just messing with me, i thought it was a joke. >> on a more serious note prosecutors believe that he did this to impress the world and when that did not work, he tried to kill the girl and the guy that she was dating. he stated that he is just happy this is over. >> my car was gone for a

kron4's scott rates was there to give us a look. >> this is an exciting. this is the very first snow of the season. it's started to pick up about 3900 c for those driving up right 80. let me show you something, i will grab some small off the ground to give you an ideal of how thick it is. you can have a snowball fight if you wanted to. it certainly is pretty scary it >> as we look at pictures, caltran has been out here with their snow plows and keeping the roads clear, the best that they can. highway patrol has also been out here to monitor the conditions and are requiring people to put chains on their vehicles as certain sections. the snow is really blake a thing a lot of the area. some of our results

shut them down. the requirement is part of a broad series of abortion limits. approved by the legislature in july. it calls for all doctors performing abortions in the state. to have admitting privileges at a hospital less than 30 miles away. the judge says the law imposes an unconstitutional burden on women seeking to terminate a pregnancy. >> the city of irwin-dale is asking a judge to stop production at a hot sauce factory. city officials say huy fong foods is stinking up neighborhoods. they say the chili odor is a public nuisance. and residents have been complaining of burning eyes, irritated throats and headaches. the company denies there's an odor problem. >> 2 charged in los angeles craigslist killing los angeles - two reputed los angeles gang members have been charged with robbing and killing a man police say was lured to his death with a craigslist ad. seventeen-year-old ryan roth and 18-year-old markell thomas were charged monday in the oct. 19 shooting of

rene balbuena, who was gunned down in front of his 15-year-old son. both were arrested last week. authorities say balbuena and his son drove to a south los angeles location at night to buy a cellphone listed on craigslist, but instead two people confronted them and demanded money. balbuena was shot several times and his son was grazed but the robbers fled empty-handed. investigators are trying to determine whether the two are connected with seven similar holdups in southern california. no one was injured in those holdups. >> for the second time in three days authorities in l- a county have found human remains. the remains were found monday in a pool at a water reclamation plant in unincorporated bassett-- about 20 miles east of downtown los angeles. the coroner will try to discover the age, sex and identity of the remains. this discovery comes after a human foot and calf were found at a county water pollution control plant in carson on saturday. investigators haven't determined whether the two

discoveries are related. >> in san francisco, you could soon pay more for sodas and other sugary drinks. city supervisor scott weiner is proposing a new tax. today he'll suggest a two- cents per ounce tax on sugary drinks. a can of soda, for example, would cost 24 cents more. the money would be used to pay for health programs for the city's young people. if approved, the proposal would go on the november ballot next year. >> this is the woman police say was driving drunk when she hit and killed two pedestrians early friday. 54-year-old marjorie reitzell of redwood city, is charged with two felony counts of manslaughter and two counts of felony driving under the influence. she's still getting medical care - and was not in court for her arraignment monday. prosecutors say her blood- alcohol level was more than twice the legal limit. >> we know about the contact

and what we found in of the car. we know that this is a way over 1.5. the exact amount will not be known until the tests are completed. >> there's a memorial near the scene of the accident. the couple killed are 50- year-old balbir singh and his wife, 45-year-old kamal singh, both of menlo park. if convicted, reitzell faces up to 15 years in prison. she's being held on one- million dollars bail. the d-a says she's still on probation from a 2012 d-u-i conviction. >> a 27 year old woman was arrest last night-- accused of killing a pedestrian in san jose while driving drunk. san jose police say monica johnson of campbell was driving on weibel way --

when she hit a pedestrian --- then slammed into a house. the woman hit by the car died at the scene. this marks san jose's 34th traffic fatality this year. >> the san francisco parks employee thomas burnoski-- who is accused of running over a woman in the park-- now has a restricted driver's license. under a court order issued monday, he can only drive for his job, child care or for counseling sessions. he's pleaded not guilty to the hit and run death of 35 year old christine svanemyr. who was laying on the grass in holly park with her child last month. burnoski was driving a city truck at the time and has been suspended from his job. >> coming up on the kron four morning news. the new way the white house is trying to get young americans to enroll in obamacare. >> here's a live look outside from the bay bridge toll plaza. it is a chilly start outside. more details on the forecast coming up.

>> consumer reports is out with its list of most reliable vehicles. zain asher has the details. >> some of the most reliable cars sold in america. aren't even made in america. consumer reports latest dependability rankings find that cars made by toyota, like lexus - are on average - the most reliable. the findings are based on subscribers' experience with more than a million vehicles. in the large/upscale category. the lexus e-s takes the top spot. another lexus vehicle - the r-x - is also the top "luxury s-u-v." --among smaller vehicles: the subaru legacy is the most reliable mid-sized car.the company's forester
